《国务院关于涉外知识产权纠纷处理的规定》已经2025年2月21日国务院第53次常务会议通过,现予公布,自2025年5月1日起施行。 | The Provisions of the State Council on the Handling of Foreign-related Intellectual Property Disputes, which have been adopted at the 53rd the executive meeting of the State Council on February 21, 2025, are hereby promulgated and shall come into effect from May 1, 2025. |

国务院关于涉外知识产权纠纷处理的规定 | Provisions of the State Council on the Handling of Foreign-related Intellectual Property Disputes |
第一条 为了加强知识产权保护,促进公民、组织依法处理涉外知识产权纠纷,维护公民、组织的合法权益,推进高水平对外开放,推动经济高质量发展,制定本规定。 | Article 1 These Provisions are formulated to strengthen intellectual property protection, facilitate citizens and organizations in legally handling foreign-related intellectual property (IP) disputes, safeguard their legitimate rights and interests, promote high-level opening-up, and drive high-quality economic development. |
第二条 国务院负责商标、专利、著作权等知识产权管理工作的部门(以下称知识产权管理部门)以及商务主管部门,加强对公民、组织处理涉外知识产权纠纷的指导和服务,国务院其他有关部门按照职责分工做好相关工作。 国务院有关部门加强工作协调和信息沟通,共同做好涉外知识产权纠纷处理相关工作。 | Article 2 The authority under the State Council responsible for the administration of intellectual property rights such as trademarks, patents, and copyrights (hereinafter referred to as the "IP administration authority") and the commerce authority under the State Council shall enhance guidance and services for citizens and organizations in handling foreign-related IP disputes. Other relevant authorities under the State Council shall perform effectively within their respective division of duties. Relevant authorities under the State Council shall strengthen coordination and information communication to jointly and effectively carry out the work related to the handling of foreign-related IP disputes. |
第三条 县级以上地方人民政府及其有关部门结合本地区实际情况,做好涉外知识产权纠纷处理相关工作。 | Article 3 Local people's governments at or above the county level and their relevant authorities shall effectively carry out the work related to the handling of foreign-related IP disputes. |
第四条 国务院知识产权管理部门以及商务、司法行政等有关部门按照职责分工及时收集和发布国外知识产权法律制度信息,完善知识产权信息公共服务体系,为公众提供国外知识产权信息查询服务。 | Article 4 The IP administration authority, the commerce authority, the judicial administrative authority, as well as other relevant authorities under the State Council shall, as per their respective division of duties, promptly collect and publish information on foreign IP regimes, enhance the public service system for IP information, and provide the public with inquiry services for foreign IP information. |
第五条 国务院知识产权管理部门、商务主管部门按照职责分工对国外知识产权法律制度变化等重点信息加强跟踪了解,开展典型案例分析研究,及时发布风险提示,为公众提供涉外知识产权预警。 | Article 5 The IP administration authority and the commerce authority under the State Council shall, as per their respective division of duties, enhance tracking and understanding of changes in foreign IP regimes and other key information, conduct analysis and research on typical cases, and promptly issue risk alert to provide foreign-related IP alert services to the public. |
第六条 国务院知识产权管理部门、商务主管部门按照职责分工健全涉外知识产权纠纷处理指导工作机构和工作规程,为公民、组织处理涉外知识产权纠纷提供应对指导和维权援助。 | Article 6 The IP administration authority and the commerce authority under the State Council shall, as per their respective division of duties, improve the working bodies and the work procedures for guiding the handling of foreign-related IP disputes, and provide strategy guidance and rights protection assistance to citizens and organizations in handling foreign-related IP disputes. |
第七条 支持商事调解组织、仲裁机构参与涉外知识产权纠纷解决,为公民、组织提供高效便捷的涉外知识产权纠纷解决途径,鼓励、引导公民、组织通过和解、调解、仲裁等方式快速解决涉外知识产权纠纷。 国务院司法行政部门加强对涉外知识产权纠纷调解、仲裁工作的指导。 | Article 7 The commercial mediation organizations and arbitration institutions shall be supported to participate in the foreign-related IP dispute resolution and provide citizens and organizations with efficient and convenient channels for resolving foreign-related IP disputes; citizens and organizations shall be encouraged and guided to quickly resolve foreign-related IP disputes through means such as reconciliation, mediation, and arbitration. The judicial administrative authority under the State Council shall enhance guidance for the mediation and arbitration of foreign-related IP disputes. |
第八条 鼓励律师事务所、知识产权服务机构等提高涉外知识产权服务能力,通过设立分支机构、联合经营等方式在国外设立执业机构,为公民、组织提供优质高效的涉外知识产权相关服务。 国务院司法行政部门、知识产权管理部门会同有关部门采取措施,为律师事务所、知识产权服务机构等加强涉外知识产权相关服务创造条件。 | Article 8 Law firms and IP service institutions, among others, shall be encouraged to enhance their capabilities in providing foreign-related IP services, set up overseas practice institutions through means such as establishing branch offices or conducting joint operations, and provide high-quality and efficient foreign-related IP and relevant services to citizens and organizations. The judicial administrative authority and IP administration authority under the State Council shall, in collaboration with other relevant authorities, adopt measures to create conditions for law firms, IP service institutions, and other entities to enhance their foreign-related IP services. |
第九条 支持企业设立涉外知识产权保护维权互助基金,鼓励保险机构按照市场化原则开展涉外知识产权相关保险业务,降低企业维权成本。 | Article 9 Enterprises shall be supported to establish mutual aid funds for foreign-related IP rights protection, and insurance institutions shall be encouraged to engage in insurance businesses related to foreign-related IP on a market-oriented basis, so as to reduce enterprises' costs in rights protection. |
第十条 鼓励商会、行业协会、跨境电商平台等组织搭建涉外知识产权维权援助平台,开通服务热线,提供咨询、培训等公益服务。 | Article 10 Chambers of commerce, industry associations, cross-border e-commerce platforms and other organizations shall be encouraged to establish platforms for assisting in the protection of foreign-related IP rights, set up service hotlines, and provide consulting, training and other non-profit services. |
第十一条 企业应当增强法治意识,建立健全内部规章制度,加强知识产权人才储备,强化知识产权保护和运用;进入国外市场,应当主动了解所在国家或者地区的法律制度、知识产权保护状况,依法开展生产经营活动,积极维护自身合法权益。 国务院知识产权管理部门、商务主管部门会同有关部门聚焦企业涉外生产经营活动中知识产权保护需求,围绕涉外知识产权纠纷重点领域和关键环节,面向企业开展宣传、培训,结合典型案例介绍依法处理涉外知识产权纠纷的经验和做法,提升企业涉外知识产权保护意识和纠纷处理能力。 国务院司法行政部门按照“谁执法谁普法”普法责任制的要求,加强知识产权相关法治宣传教育,全面提升公民、组织知识产权保护意识和依法维权能力。 | Article 11 Enterprises shall strengthen their awareness in the rule of law, establish and improve internal rules and regulations, enhance IP talent reserves, and strengthen IP protection and utilization. When entering a foreign market, enterprises shall proactively seek to understand the legal systems and IP protection situations of the host country or region, conduct production and operation activities in accordance with the law, and actively safeguard their legitimate rights and interests. The IP administration authority and commerce authority under the State Council shall, in collaboration with other relevant authorities, focus on enterprises' IP protection needs in their foreign-related business activities, and on the key areas and critical processes of foreign-related IP disputes, conduct publicity and training, and introduce the experience and practices in the lawful handling of foreign-related IP disputes by studying typical cases, thereby enhancing enterprises' awareness in foreign-related IP protection and their capabilities to handle disputes. The judicial administrative authority under the State Council shall, based on principle that "whoever conducts law enforcement shall be responsible for popularizing legal knowledge", strengthen legal publicity and education related to IP rights, comprehensively enhance citizens' and organizations' awareness in IP protection and their capabilities to lawfully safeguard their rights. |
第十二条 在我国境内送达文书、调查取证应当依照我国缔结或者参加的国际条约以及《中华人民共和国民事诉讼法》、《中华人民共和国国际刑事司法协助法》等法律规定办理。任何组织和个人均不得违反我国法律规定,在我国境内送达文书、调查取证。 | Article 12 Any service of document and collection of evidence within the territory of China shall be conducted in accordance with the international treaties concluded or acceded to by China, as well as the Civil Procedure Law of the People's Republic of China, the Law of the People's Republic of China on International Judicial Assistance in Criminal Matters, among other laws. No organization or individual shall serve any documents or collect any evidence within the territory of China in violation of Chinese laws. |
第十三条 我国境内的组织、个人参与境外知识产权相关诉讼或者受到境外司法或执法机构相关调查,需要向境外提供证据或者相关材料的,应当遵守保守国家秘密、数据安全、个人信息保护、技术出口管理、司法协助等法律、行政法规规定。依法须经主管机关准许的,应当履行相关法律程序。 | Article 13 Where organizations or individuals within the territory of China participate in overseas IP-related litigation or are subject to relevant investigations by foreign judicial or law enforcement authorities and need to provide evidence or relevant materials to foreign parties, they shall comply with laws and administrative regulations on the protection of state secrets, data security, personal information protection, technology export control, and judicial assistance. Where an approval from the competent authorities is required by law, the relevant legal procedures shall be followed. |
第十四条 国务院商务主管部门可以依照《中华人民共和国对外贸易法》对下列事项进行调查并采取必要的措施: (一)进口货物侵犯知识产权,并危害对外贸易秩序的; (二)知识产权权利人有阻止被许可人对许可合同中的知识产权的有效性提出质疑、进行强制性一揽子许可、在许可合同中规定排他性返授条件等行为之一,并危害对外贸易公平竞争秩序的; (三)其他国家或者地区在知识产权保护方面未给予我国公民、组织国民待遇,或者不能对来源于我国的货物、技术或者服务提供充分有效的知识产权保护的。 | Article 14 The competent commerce department under the State Council may, in accordance with the Foreign Trade Law of the People's Republic of China, launch investigation into and take necessary measures for the following matters: (1) Where any import of goods infringes IP rights and disrupts the order of foreign trade; (2) Where an IP rights holder prevents the licensee from challenging the validity of the IP right in a license agreement, or imposes mandatory package licensing, or includes an exclusive grant-back clause in the license agreement, thereby disrupting the fair competition order of foreign trade; (3) Where other countries or regions fail to grant national treatment to Chinese citizens or organizations in IP protection, or fail to provide adequate and effective IP protection for goods, technology, or services originating from China. |
第十五条 外国国家违反国际法和国际关系基本准则,以知识产权纠纷为借口对我国进行遏制、打压,对我国公民、组织采取歧视性限制措施,干涉我国内政的,国务院有关部门可以依照《中华人民共和国对外关系法》、《中华人民共和国反外国制裁法》等法律将直接或者间接参与制定、决定、实施歧视性限制措施的组织、个人列入反制清单,采取相应反制和限制措施。 | Article 15 Where a foreign country, in violation of international law and the fundamental principles of international relations, suppresses or sanctions China, imposes discriminatory restrictive measures against Chinese citizens or organizations, or interferes in China's internal affairs under the pretext of IP disputes, relevant authorities under the State Council may, in accordance with the Law on Foreign Relations of the People's Republic of China, the Law of the People's Republic of China on Countering Foreign Sanctions, and other laws, include the organizations or individuals directly or indirectly involved in formulating, deciding, or implementing such discriminatory restrictive measures on a countermeasure list and adopt corresponding countermeasures and restrictive measures. |
第十六条 任何组织和个人均不得执行或者协助执行外国国家以知识产权纠纷为借口对我国公民、组织采取的歧视性限制措施。 任何组织和个人违反前款规定,侵害我国公民、组织合法权益的,我国公民、组织可以依法向人民法院提起诉讼,要求其停止侵害、赔偿损失。 | Article 16 No organization or individual shall implement or assist in implementing any discriminatory restrictive measures imposed by foreign countries against Chinese citizens or organizations under the pretext of IP disputes. Where an organization or individual violates the preceding paragraph and infringes upon the legitimate rights and interests of Chinese citizens or organizations, the said Chinese citizens or organizations may file a lawsuit with the people's court in accordance with the law to request cessation of the infringement and compensation for losses. |
第十七条 国务院有关部门加强协调配合,对利用知识产权纠纷危害我国主权、安全、发展利益的,依照《中华人民共和国国家安全法》、《中华人民共和国对外关系法》、《中华人民共和国反外国制裁法》等法律采取相应措施;对滥用知识产权排除、限制竞争或者实施不正当竞争等行为的,依照《中华人民共和国反垄断法》、《中华人民共和国反不正当竞争法》等法律予以处理。 | Article 17 Relevant authorities under the State Council shall strengthen coordination and cooperation, and take corresponding measures against those who utilize IP disputes to endanger China's sovereignty, security, or development interests in accordance with the National Security Law of the People's Republic of China, the Law on Foreign Relations of the People's Republic of China, the Law of the People's Republic of China on Countering Foreign Sanctions, and other laws. Those who abuse IP rights to exclude or restrict competition or engage in unfair competition shall be subject to measures in accordance with the Anti-Monopoly Law of the People's Republic of China, the Anti-Unfair Competition Law of the People's Republic of China, and other laws. |
第十八条 本规定自2025年5月1日起施行。 | Article 18 These Provisions shall come into effect from May 1, 2025. |
